A Message from Roger P. Foley – My Personal Injury Journey

Many years ago, I created a video to announce that I was beginning to handle personal injury cases. That moment marked the start of an important chapter in my legal career—and I’m still here, still fighting for injury victims across Florida.

Since that time, I’ve gained a tremendous amount of experience and continue to grow with every case. My primary focus is on serving clients in Broward, Palm Beach, and Martin Counties, but I proudly accept personal injury cases throughout the entire state of Florida.

Some cases are resolved through settlients, while others require filing lawsuits and going to court. When a case involves complex legal or financial issues—such as those involving catastrophic injuries, wrongful death, or boating accidents under federal admiralty law—I may partner with other trusted law firms. These partnerships are not about ego—they’re about getting results for my clients.

If teaming up with another firm gives my client access to specialized knowledge, greater resources, or additional support, then that’s exactly what I’ll do. The contingency fee remains the same for the client—no extra cost. In these cases, the attorneys either split the fee (typically 50/50) or I may receive a referral fee, depending on my level of involvement. Regardless, my client’s best interest always comes first.

I'm not too proud to bring in help when it’s needed. For instance, if a case involves medical malpractice or federal maritime law, I will do the research, build the right legal team, and make sure no stone is left unturned. My role is to protect you, guide you, and seek justice—because when someone suffers a serious injury or loses a loved one, financial compensation is often the only form of justice the legal system allows.

As a God-fearing man and someone who strives to live with honesty and integrity, I commit to doing what’s best for you—even if it means stepping back and referring the case to a specialist. That mentality has never hurt me; in fact, it’s helped me grow. Clients recognize when their attorney genuinely cares. What You Really Need to Know After a Car, Bicycle, Motorcycle, or Boating Accident – And in Wrongful Death Cases

If you're reading this, it likely means something has gone terribly wrong. A crash. An injury. Maybe even the loss of someone you love. You’re overwhelmed, in pain, and unsure of what to do next. I get it. I’ve walked through these cases with hundreds of clients, and I’ve seen firsthand how quickly things can spiral when people don’t get the right help—or the right information.

This article isn’t full of legal jargon or cookie-cutter advice. You won’t find generic statements here like “we fight for you” or “we’re aggressive.” What you’ll find is straight talk, real guidance, and a commitment to helping you make the best decisions after an accident—decisions that could impact the rest of your life.

First Things First: What to Do At the Scene

Let’s be honest: Not everything is possible right after an accident. You may be in shock or physically unable to move. But if you can, here are the things that matter most in the moment:

  • Call 911. Always. Even if the damage seems minor or you "feel okay." A police report is your first piece of evidence.
  • Get medical care—immediately. If you're injured, go to the hospital. You have at least $10,000 in Personal Injury Protection (PIP) through your Florida auto insurance policy. That’s money available regardless of fault, so use it. If you planned ahead, you might also have Uninsured or Underinsured Motorist coverage—which can help if the person who hit you has little or no insurance.
  • Take photos and videos. Get shots of all vehicles, damage, license plates, street signs, lighting, weather conditions, and visible injuries.
  • Don’t admit fault. Even a casual “I’m sorry” can be twisted against you. Stick to facts and let investigators sort it out.
  • Collect witness info. Don’t assume law enforcement will gather all names and numbers. Grab them yourself if you can.
This Is Not the Time to Be Tough

I hear this all the time:

“I have a high pain tolerance.”
“I didn’t want to make a big deal out of it.”
“I figured I’d sleep it off.”

Let me be clear: Being “tough” can ruin your injury case.

If you delay treatment, the insurance company will argue you weren’t really hurt. And if you don’t clearly explain every symptom to your doctor—from head to toe—it won’t end up in your medical records.

If it’s not documented, it didn’t happen. And if it didn’t happen on paper, you don’t get paid for it.

Go to the hospital. Take the ambulance if you need it. Or have a friend or family member take you immediately. And when you get there, don’t minimize anything. Neck pain? Say it. Dizziness? Say it. Tingling in your feet? Say it. Be honest and complete.

Say nothing? Get nothing. No tough guys needed. Be smart.

What to Do After the Accident

Once the immediate danger is over, your decisions in the next 24 to 48 hours can make or break your case. Here’s what you need to do:

  • Call a lawyer right away. The sooner we speak, the better I can protect your case. My office moves quickly—we line up experts, private investigators, accident reconstructionists, and medical professionals as needed.
  • Do NOT talk to the insurance company. Even if it's your own. Let me do that for you. Insurance adjusters are trained to limit payouts. They’ll record your statements and twist your words later.
  • Start treatment—and stick with it. Skipping medical appointments or “toughing it out” looks bad to the insurance companies. They’ll assume you’re fine. If you stop treating, they stop paying.
What About Wrongful Death?

If you’ve lost a loved one in a crash or accident, you’re dealing with grief, confusion, and maybe anger. It’s a tragedy, and no lawsuit can fix it. But Florida law does allow for financial justice in the form of a wrongful death claim.

That money can cover funeral expenses, lost income, future support, and more. It’s not about greed—it’s about holding the responsible party accountable and protecting the family left behind.
