Facts: During the time the defendant was working at the barn, she was responsible for the care and training of the horses. According to witness statements, the defendant committed the crime of animal cruelty as she intentionally committed an act to an animal which resulted in the excessive or repeated infliction of unnecessary pain or suffering by punching the horses with a closed fist and whipping them in the face with the reins or a lunging whip.
Charges: Cruelty to animals (828.12(2)) – Maximum Penalty: 5 years in prison
Process: Mr. Foley took the necessary depositions of the case. He then contacted equestrian experts and consulted with them regarding the proper training methods. Mr. Foley then discussed said methods with the assistant state attorney assigned to the case. Based on all the forgoing information, the state dismissed the charge.
